(c) OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE PRODUCT OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE PRODUCT IN THE PAST SIX (6) MONTHS.

7. Binding Individual Arbitration Agreement & Class Action Waiver (U.S. Customers)
You and HARD CHEWS agree that any dispute, claim, or controversy arising out of or relating in any way to the Product, these Terms, or your purchase shall be determined by binding arbitration on an individual basis instead of in courts of general jurisdiction.

Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (available at www.adr.org or by calling 1-800-778-7879).
The arbitration will take place in Sheridan, Wyoming or, if you prefer, by telephone or video conference.
The arbitrator’s award shall be final and may be entered as a judgment in any court of competent jurisdiction.
YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR OTHER REPRESENTATIVE PROCEEDING. You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or class member in any class, consolidated, or representative action.

If any portion of this arbitration provision is found unenforceable, the remainder shall remain in full force and effect.

These Terms and any dispute between you and us shall be governed by the laws of the State of Wyoming, without regard to conflict of law principles.

9. Indemnification

You agree to indemnify, defend, and hold harmless HARD CHEWS, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Product or violation of these Terms.

By ordering, you consent to receive communications from us electronically and agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
